TERMS AND CONDITIONS:

CONTRACT

Curtis Wallis Photography, Inc. (“Photographer”) agrees to provide photography and related services as
specified in the Wedding Package for Client’s wedding event
(“Event”) described in the Event Details with invoice on the following terms and conditions:

1.
Payment Policy. A retainer of $350 is deposited herewith to reserve event coverage on the above date and
will be applied to the total cost of the Wedding Package as reflected in Attachment 1. A receipt for the
retainer is attached as Attachment 4. The remaining balance is due 2 weeks prior to Event.

2.
Cancellation. Upon acceptance of this Contract, Photographer reserves the time and date and will not make any other reservations for that date. For this reason, the retainer is non-refundable, even if the Client cancels the order for photography, or changes the date of the wedding. However, if the Client cancels but Photographer is able to contract another wedding assignment for the cancelled date, the full sum of the retainer will be refunded, minus an administrative fee of $100. Deposit non-refundable, 50% of total due if after 180 days prior to wedding date.

3.
Copyright. As the author of all images made hereunder, Photographer reserves and retains full copyright to all images provided, per U.S.C. Title 17 (U.S. Copyright Law). Client agrees that Photographer is free to use all images and/or reproductions for advertising, display, contest entry, publication or other purposes. Photographer grants Client a limited license to make unlimited copies and reprints of all images from the high-resolution thumb drive or download, provided images are part of specified package, for personal use only. The high-resolution Thumb drive shall contain the same images as the wedding day proofs presented to Client.

4.
Officiant and Venue Restrictions. Photographer may be limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. Client understands and agrees that Photographer will abide
by such guidelines or rules as they are outside the control of Photographer. Client agrees to release and hold Photographer harmless for the impact such guidelines or rules may have on the finished product.

5.
Exclusivity. Client acknowledges that Photographer shall be the sole and exclusive professional photographer for the Event. Client further acknowledges that Photographer is not responsible for the impact on the final product of any interference during the photography process by guests or other vendors.

6.
Limitation of Liability. While reasonable efforts will be made to produce and deliver outstanding images of the wedding events, Photographer’s maximum liability to Client for any claim, loss, damage, or injury arising under or relating to this Agreement or Photographer’s performance hereunder, is limited, to the extent permitted by law, to a refund to Client of all sums paid pursuant to this Contract. Because a wedding is an uncontrolled event, Photographer cannot guarantee delivery of any specific image(s). In the unlikely event that Photographer is unable to provide the photographic se vices for any reason including, but not limited to, illness, injury, or act of God, Photographer will exercise its best efforts to secure a replacement photographer acceptable to Client. If an acceptable replacement is not found, Photographer shall immediately refund all monies paid, including the retainer.

7.
Model Release. The Client hereby assigns and grants “Curtis Wallis Photography” and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases “Curtis Wallis Photography” and its legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that “Curtis Wallis Photography” may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in malls, photography books, photography instructional books, store fronts, window displays, studio display, television advertising, magazine advertising and any other purpose thought proper by “Curtis Wallis Photography”.

8.
LOCATION ACCESS, FEES + PERMITS: If CLIENTS  want to shoot at a location that charges for access or requires permits, CLIENTS  shall be responsible for all fees associated with shooting there, including but not limited to entrance fees and parking. CLIENTS  shall also be responsible for organizing access to the location and any permits required for doing so.

ADDITIONAL IMAGES/RAW IMAGES: The Studio does not guarantee a minimum number of images in the CLIENTS  final portfolio. Under no circumstance will The Studio release RAW images to CLIENTS. Clients images will be 8×10 inch JPEG files. The Studio selects the best representation of the images taken at the wedding/associated sessions for the CLIENTS’  portfolio, and all other images are deleted during the culling process; therefore, no additional images can or will be released to CLIENTS.

I hereby affirm that I am over the age of majority and have the right to contract in my own name. I have read the above authorization, release and agreement, prior to its execution; I fully understand the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns. This Contract constitutes the entire agreement between the parties and may only be modified in writing by both parties.
